Driveway Crossing Applications

Technical Services Division - Driveway Crossing Information

A driveway consists of a crossing of Councils road side drain or gutter and provides access from the edge of the formed road onto a property. 

The crossing of the drain of gutter is either:

·         A pipe and concrete headwalls;
·         A concrete dish drain, or;
·         A “layback” in the kerb and gutter. 

The driveway has a surfacing resistant to wear and the effects of water.  Such a surfacing would be either:-

·         Compacted gravel or road base;
·         Bitumen or asphalt;
·         Concrete, or
·         Paving bricks. 

Council does not have the staff resources to construct driveways, but can provide a list of approved contractors who can do this work. 

You have two options when it comes to having a driveway constructed: 

1.       Carry out the work yourself using your own contractor, in which case you must complete an application form
          available from Council’s Technical Services Division.  If you choose this option you must pay a $300.00 security
          bond (refundable from Council when the driveway is completed to Council specifications); or

2.              Use an authorised contractor registered with Council – if you choose this option you must adhere to the following:-

a)      obtain a list of approved contractors from Council;
b)      get quotations for the job; accept a quotation and have the work done;
c)      contact Council on completion and have the job checked;
d)      if the job is approved by Council, make a final payment to the contractor. 

It is important that Council approve the location and type of driveway before construction begins.  Please note that approval of a driveway crossing in no way implies that Council will approve the erection of a carport and/or garage in the same location in the future.  Approval for this must be applied for through Council’s Environment & Planning department. 

Please Note:    Section 218 below, is an extract taken from the Roads Act relating to adjoining land owner’s responsibilities. 

“218 Roads authority may recover cost of constructing or repairing a special crossing”“(1) The owner of land adjoining a public road is liable to pay to the appropriate roads authority the cost incurred by the roads authority in constructing or repairing any special crossing over a footway in the public road for the traffic of vehicles across the footway to or from the land.(2) If the crossing has been constructed or repaired at the request of the occupier of the land concerned, any amount paid to the roads authority by the owner of the land may be recovered by the owner from the occupier.”
